ENVIRONMENTAL REINSURANCE
The firm has developed a practice to address environmental/asbestos/mass tort issues. The firm's attorneys work closely with clients to address all aspects of aggregation, allocation and coverage issues which pervade this area of reinsurance. The firm has been particularly successful in assisting clients to craft protocols for the consistent handling of the delicate issues which arise, including questions of ultimate responsibility for the expense of declaratory judgment actions and the manner in which dates of loss are selected.
The firm's attorneys believe that in the handling of environmental reinsurance issues including asbestos and pollution, and other mass tort claims, one must analyze the case from both a strategic as well as a tactical viewpoint. This is particularly important, as one adverse judgment could preclude the re-litigation of a particular issue in the future. Moreover, it is frequently critical to examine the retrocessional program for a client before advising what position should be taken on assumed business.
